Commerce Department Completes Rulemaking Process for PBM LIcensure

The Minnesota Department of Commerce has completed the rulemaking process for Minnesota Rules, Chapter 2737 (Licensure and Regulation of PBMs). MPhA and the Minnesota Pharmacy Alliance worked diligently to pass the bill that triggered the rulemaking process, and our members have provided input on the rulemaking process.

The Commissioner of Commerce signed the Order Adopting Rules on December 7, 2021. The rules were subsequently filed with the Secretary of State's office on December 15, 2021, beginning the 14-day period during which the Governor may veto rules. No veto occurred during that time.

The Department's official notice regarding adoption of these rules are included in the Jan. 10 State Register publication.
The adopted rules will become effective on Jan. 18, 2022.
